TOLEDO – Convicted Islamic Center arsonist Randolph Linn is appealing the judgement in his case.
Papers giving notice of the intent to appeal were filed in U.S. District Court of Toledo today by Linn’s attorney, John Thebes.
The document states that the “defendant, by and through counsel, gives notice of his intent to appeal the amended judgment of April 16, 2013, in this matter.”
The “amended judgment” refers to a slight revision to the official judement, filed April 17, correcting the end date of the offense.
Specific reasoning and arguments of the appeal have not yet been filed.
Linn, 52, St. Joe, Ind., was sentenced April 16 to 20 years in prison, and a $1.4 million restitution, in the Sept. 20 arson at the Islamic Center of Greater Toledo.
Linn pleaded guilty to federal hate crimes and weapons charges in the incident in December, but later sought a plea withdrawal based on issues including that his mental state was not taken into consideration during the proceedings.
That motion was denied prior to sentencing.
