VAN VORHIS, ET AL FOR THE ACQUISITION OF PROPERTY ON NEWTON ROAD FOR CONSTRUCTION OF A WATER TOWER, AND AUTHORIZING THE UTILITIES DIRECTOR TO COMPLETE THE PURCHASE IN ACCORDANCE WITH SAID CONTRACT, AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BOWLING GREEN, COUNTY OF WOOD, AND STATE OF OHIO SECTION 1: That the Utilities Director is hereby authorized to enter into a contract with Richard P. Van Vorhis, Trustee, et al, in substantial accordance with the exhibit attached hereto and made a part hereof, for purposes of acquiring approximately 0.951 acres on West Newton Road for purposes of constructing a water tower and related facilities, and then to complete all the terms of said contract including acquisition of said property in accordance with the agreement. SECTION 2: This ordinance shall take effect as an emergency measure. The reason for the emergency is that the prompt implementation of this legislation is necessary in order to meet approval of financing deadlines by the Ohio EPA and the Ohio Public Water Commission, so as to facilitate construction of the water tower which is necessary for the safe and efficient operation of the water distribution system in the City, thereby protecting the public health, safety and well-being or our citizens.
